 环境管理要求 14.1 介绍 This chapter addresses the environmental issues related to the Red Line Works and conveys information provided by the Employer, environmental advisors, designers, the Ministry of Environmental Protection (MoEP), and others regarding the Works required by the Contract. It establishes the environmental management requirements with which the Contractor must comply.

 14.1.2 内容 This chapter demonstrates how the Works will comply with the spirit of the Environmental Policy developed by the Employer for its planning, construction and operating activities. The Employer sees sustainability and protection of the environment as part of its responsibilities. When operational, the LRT will provide a sustainable means of transportation in the cities; will result in considerable improvements in the quality of life for residents in the Tel Aviv metropolitan area; and will enable reduced vehicle emissions, thus contributing towards improvement in air quality and ambient noise in the cities.

 (i)尽可能的减小不利环境影响 4. The Employer expects his partners, contractors and suppliers to adopt and implement the principles contained within this Policy and will achieve this through his procurement activities.

 (d)持续监控和提升环境性能 6. The Works will take place in a densely populated urban environment along a linear route. Environmental restrictions, limitations and constraints are common in such environments. The Contractor shall need to take measures to:

 (a) Obtain the necessary permits and approvals where applicable, and comply with the applicable permits and approvals and the conditions specified therein

 as required by the Engineer.

These Documents are part of the Permit process as explained in Volume 3, Part VII, Chapter 10.  2. The relevant section of the Employer’s Environmental Documents, after approval by the authorities will be attached to each Permit.  3. The Employers Environmental Documents are indicative documents used for the purpose of defining the environmental controls and mechanisms required to achieve the necessary permits from MoEP. The obligations that are included in the Environmental Documents will be attached to the Permits as explained in Clause

 4. The Employer"s Environmental Documents represent the mechanisms by which the environmental impacts of the Works shall be controlled. Unless specifically provided otherwise in Volume 3, Part VII, Chapter 10, the Contractor shall obtain all necessary permits from the MoEP and other Authorities. In the event of variation or changes from the information presented in the Employer"s Environmental Documents, the Contractor shall prepare and submit further Environmental Documents to the Engineer for review and acceptance prior to the

The Contractor shall be responsible for obtaining all necessary approvals and shall be solely liable for all costs and risks associated with the preparation of further Environmental Documents and in ensuring satisfactory completion of the Works.  14.1.6 环境管理计划 1. The Contractor shall submit a Contract-specific Environmental Management Plan that is based on the information in this document and further shows how the Works will comply with the requirements of NTA’s Environmental Policy. The objectives of the Contractor’s Environmental Management Plan shall be to:

 (a) Achieve compliance with all regulatory requirements and consents as well as with NTA’s Environmental Policy

 (c)交付最好环境性能 2. This chapter sets forth the Employer’s minimum requirements for the Environmental Management Plan. Works-specific restrictions and/or requirements are contained within the Environmental Documents for each Station Box and TBM detailed in Volume 4, Part XV.

 3. The Contractor shall submit to the Engineer for review an Environmental Management Plan within 56 days from the Commencement Date. The Engineer will comment and reply on its acceptability within 28 days of the date of submission. Any further revisions, submissions, and responses shall be made within the period for reply, and the Contractor shall make due allowance in his program to achieve satisfactory completion of the Works.

 4. The Contractor shall not commence with any work at any site until the Engineer has reviewed the Environmental Management Plan.

 5. The Environmental Management Plan shall include, but not necessarily be limited to:

 (a) Management processes and procedures for complying with legal requirements

 and the environmental requirements contained within this chapter.

 6. From the Commencement Date, the Contractor shall develop and implement the Environmental Management Plan, which shall be maintained throughout its lifecycle as a live document. The Environmental Management Plan will set out the arrangements for managing environmental issues by the Contractor. The Plan will also apply to Subcontractors, Nominated Subcontractors to the Contractor and all those carrying out the Works, and to all those who might be affected by them.

 7. When developing the Environmental Management Plan, the Contractor shall identify the aspects and assess the impacts and risks at each of the main stages of the design and construction phases for the Works and at remote locations as appropriate, including but not necessarily limited to those identified in this document. The Environmental Management Plan shall cover the breadth of their activities as related

 to the Works.

 8. The Environmental Management Plan shall be reviewed, kept up to date, modified and altered by the Contractor in the light of changing circumstances, including changes in legislation. As the design and construction work progresses, parts of the Environmental Management Plan will need to be amended and updated as a result of impact/risk assessments and Environmental Document provided by the Contractor prior to and during the execution of the Work during the various stages.

 9. Reviews of the Environmental Management Plan should be undertaken if there are design changes or unforeseen circumstances. It is vital that anyone working on-site who might be affected by the change in Works be notified accordingly.

 10. The Contractor shall establish a Change Register to record all changes made to its Environmental Management Plan, which will be reviewed by the Engineer.

 11. The construction phase includes, but is not limited to, site preparation, site clearance including any necessary demolition, drilling of boreholes, drainage works, erection of fencing, relocation of services (if applicable), off- site pre-works mitigation activities, etc., as well as all excavation and construction activities within each of the sites. The installation phase includes mechanical, electrical and plumbing design and installation and tunnel services. As such, the Contractor’s Environmental Management Plan shall cover all activities undertaken by his Subcontractors. Restoration of work sites is also required where applicable and is covered by the environmental requirements included here.

 12. The Contractor should undertake its own assessment of the environmental control and management requirements associated with the Contract. The requirements set forth in this document are minimum requirements. The Contractor shall be fully familiar and implement plans and programs which comply with all the Laws and all applicable environmental laws, regulations and municipal by-laws and guidelines for environmental requirements amended from time to time unless otherwise agreed.

 13. Various documents are referred to in this section of the Contract; Figure 14-1 illustrates the relationship between each of them. This figure is for information purposes only and the Contractor shall develop its own structure providing that it satisfies the criteria for Plans, etc., given in this document.

 14. The environmental information issued by the Employer is current and relevant to the Works at the time of issuance of this Chapter. The Employer is not responsible for the accuracy and completeness of this information; the Contractor shall, at his own cost, verify the accuracy of the information. The Contractor’s submission of the Environmental Management Plan shall mirror the Works information and develop such to a sufficient level for the Date of its Submission to demonstrate Works specific competency, sufficient resources, the provision of suitable arrangements and controls, aspect and impact/risk management, and supervisory arrangements.

 15. The Environmental Management Plan shall cover all environmental topics including but not limited to; excavated soil management, contaminated soil disposal, water management, noise and vibration, spill control, nuisance, air quality, waste

 management, terrestrial habitats management heritage, archaeology and without obstruction to surrounding areas.

 16. The Contractor shall undertake all environmental modeling and monitoring exercises needed to obtain the necessary Permits and approvals (including the Environment Documents). The modeling techniques used in the Employer"s Environmental Documents are provided for illustrative purposes only and the Contractor should not take them as accepted mechanisms for determining the scale of environmental impact. The Contractor shall obtain all necessary approvals for modeling exercises and monitoring regimes from the Authorities.

 16.承包商应当保证所有的环境模型和监控都需要获得必要的批准和允许。业主环境文档中使用的技术模型被提供为这些直观的目的,承包商不应该把他们作为可接受的机制,决定环境影响的规模。承包商应当为建模练习获取所有必要的批准,和从当局获取监控制度。

  14.2 人力资源 14.2.1 承包商的环境团队 1. The Contractor shall identify on an organization chart the structure of its Environmental team and its reporting lines, including relationships with Subcontractors). The Contractor"s Environment Team shall be of a size sufficient to manage the requirements of Permits, the Environmental Documents, and the environmental management responsibilities that the Contract will require.

 2. The responsibilities of each member of the Contractor’s Environmental Team shall be clearly defined and submitted to the Engineer for review prior to the Commencement Date. The organization chart, staffing and definition of roles and

 responsibilities shall be included as part of the Contractor’s Environmental Management System) and shall be kept updated by the Contractor.

 3. The Contractor shall appoint an Environmental Manager and other environmental specialists where required by other parts of this Contract or where necessary for Completion of the Works.

 4. The Contractor shall submit the curriculum vitae of all proposed environmental personnel to the Engineer for review. Environmental personnel shall not be appointed at any time during the execution of the Works until their curriculum vitae have been reviewed by the Engineer.

 5. Where the Contractor proposes to fulfill the Environmental Management roles through appointment of sub-consultants, review of any companies involved shall also be obtained in advance from the Engineer.

 6. The Contractor shall appoint, as a minimum, an Environmental Manager and

 an Environmental Deputy who shall be dedicated full time to the Works. At least one of these appointees shall be available during all working hours, have relevant environmental construction experience, and hold relevant academic and professional qualifications. These staff shall be present until Works completion has been achieved.

 (m) Liaise with the Contractor’s procurement personnel to ensure that procurement incorporates sustainability

 (s) Apply for, maintain, and hold the Toxic Permit as required

 (s)申请、维持被要求的毒气许可 3. The Environmental Manager shall have the following competencies, experience and qualifications:

 (a) B.Sc. (or equivalent) in an environmental subject

 (a)环境主题 (b) Minimum of five (5) years post graduate experience in areas relevant to these Works, including a minimum of three (3) years related experience in environmental management of similar scale construction projects, including on-site monitoring and supervision of sub-consultants

 (c) Good knowledge and practical experience in the application of legal environmental requirements and how to comply with them, including but not restricted to noise and vibration, surface and groundwater, contaminated land, waste and air quality

 1. The Contractor shall appoint at least two (2) Environmental Officers, one of whom must be able to act as an Environmental Deputy to cover for leave, shift work and illness of the Environment Manager. The Environmental Deputy must satisfy the same minimum qualifications and experience as the Environmental Manager.

 serve as his/her deputy when the Environmental Manager is absent. Consequently, the Environmental Officers shall have appropriate qualifications and sufficient experience to enable them to successfully discharge their responsibilities as detailed above.

 14.2.1.3 环境专家顾问 The Contractor shall provide specialist environmental staff, consultants or Subcontractors (and their equipment) as necessary to fulfill the duties required by the permits and the Environment Documents. The Contractor shall submit full curriculum vitae of the proposed individuals for review by the Engineer. This shall include as a minimum the experts listed below. All environmental experts shall have:

 承包商应当提供环境专家人员、顾问或者分包商,满足批准和环境文档的要求。承包商应当递交被提议人员的简历给工程师审查。

 1. excellent Hebrew and English written and verbal skills; 1. 优秀的英语和希伯来语读写能力 2. at least a Bachelor degree or equivalent degree in their professional field;

 3.至少 5 年的专业经验 4. experience of working in utility and infrastructure construction sites. Noise and Vibration Specialist

 4.公共设施和基础设计建设经验,噪音和震动专家 The Contractor shall appoint a Noise and Vibration Specialist who shall:

 承包商应当任命噪音和震动专家 (a) Advise and instruct construction teams on how to meet legal and contractual noise and vibration requirements, including consents from relevant Authorities

 (a)建议和指导建造团队,满足法规及合同噪音和震动要求,包括相关当局批准 (b) Develop and implement the Noise and Vibration Management Plan as part of the Environmental Management Plan for the Works (see clause 14.4.1below)

 (b)开展和执行噪音和震动管理计划作为环境管理计划的一部分 (c) Work closely with construction teams, particularly the construction planning team to manage noise and vibration impacts
